Telephonic solicitors include all voice communication to a telephone number in Arizona from a live operator, announcing device, or other means of offering merchandise for sale or rent.

The law prohibits caller identification blocking devices, artificial or prerecorded voices and unsolicited telephone calls to any mobile or telephone paging system. Solicitors must maintain a "no call" list of consumers who have previously stated that they do not want calls from a seller.

Telephone Solicitation companies in Arizona are required to register with the Secretary of State as one of three registration types: full registration, limited registration, and a filing exemption. Registration includes obtaining a $100,000 surety bond.

Registration and Bond Requirements

Registration with the Secretary of State includes:

  • Corporations and Limited Liability Companies must submit a copy of its articles of incorporation, bylaws and amendments to the bylaws.
  • A copy of the script, outline or presentation that the sellers will use. If the script gets revised, then the new version must be submitted.
  • Sales information and literature provided by the seller to a solicitor must be provided.
  • Sales information and literature provided by the seller to a consumer must be provided.
  • Each of the seller's principals and/or managers must provide a current driver's license or valid government issued photo ID.
  • Provide a $100,000 surety bond or cash deposit
